Q&A: Jihad is not the method to establish khilafat...

Question:

Assalaamu Aalaikum our honorable Ameer,

we see the establishment of khalifa and are jihad are different obligation justifying the point that jihad can't be the methodology to establish the khilagah.can you explain that these tow are different obligations?

May Allah accept from you and give you the responsibillity to guide the Ummah.

Answer:
Wa Alaikum Assalm Wa Rahmatullahi Wa Barakatoh

There are basic issues we should understand they clarify answer:

1.The required evidence (daleel) for deducing a legal rule (Hukm shae'i) to an issue is the one that pertains to that issue rather than the evidence that pertains to another issue:

A. For example, if wanted to know how to perform ablution, i would search for evidences pertaining to ablution where they are found, whether revealed in Macca or in Madina.The shar;i ruling is then extracted duly the followed methodology(Usul)...But would not research evidence on fasting to extract from them ruling on ablution and how to perform it.

B. Another example, if waned to know about the Ahkam of pilgrimage (Haj), i would search for evidences pertaining to (Haj) where they are found, whether revealed in Macca or in Madina.The shar'i is then extracted duly the followed Usul..but i would not research evidence on salat(prayer) to extract from them the ruling on Haj and how to perform it.

C. Similarly, if i wanted to know the Ahkam of jihad: whether as an obligation on the individual or as a collective obligation , in defense or aggression, and what pertain to jihad including the Ahkam of conqueste (faith) and spreading Islam, whether conquest take place by force or through conciliation ...i would research the evidences on the jihad where there are found, whether revealed in Macca or in Madina, and deduce the shar'i ruling duly the followed Usul... but i would not research the evidence on zakat to extract from them the ruling on jihad and its details.

D. And so in every issue, evidence is researched whether revealed in Macca or in Madina, and from evidences the shar'i ruling is taken for the issue duly the followed Usul.

2. Now we come to the question of establish an islamic state, and we search for it evidences, whether revealed in Macca or in Madina, and extract the hukm shar;i for it duly the followed Usul.

A. We do not find any evidence to establish an Islamic state, except that which was demonstrated by Rasulullah (saw) his Seerah in Mecca, he called the people to islam secretly, then created a believing, patient group ...then he proclaimed it among the people in Mecca and its surrounding during the season ...He then sought Nusrah(support) from the people of power and strength.Eventually Allah honored him with Al-anser, so he (saw) emigrated to them and established the state.

B. The prophet(saw) did not fight the people of Mecca to establish the state, and did not fight any tribe in order to establish the state, despite that he (saw) and his companions, Allah be please with them, were heroes in fighting, strong and pious but the (saw) did not fighting for the establishment of the state but continued to call to Islam and seek the Nusrah from the people of power until al-ansar responded to him and established the state.

C. Then the Ahkam of jihad were obliged for the conquest (Fat'h), the spreading of Islam and the protection the Islam state, jihad was not obliged for the establishment of the state and all this is clearly evident in his Seerah.

D.And so if we want to know  how to establish the state, then this should be taken from the action of Rasulullah (saw) in Dawah, seeking Nusrah,the response of al-ansar and the establishment of the state, and if we want to know the Ahkam of jihad, these should be taken from the Shariah evidences related to jihad. thus the evidence for every obligation is taken from the shariah evidence partaking to it, the establishment of the state is taken from the evidences pertaining the establishment of the state, the jihad from the evidence  of jihad, and we have to commit to it and Allah is the source of success.

ইসলামের অর্থনৈতিক ব্যবস্হা.....

আমরা যদি পুজিবাদী অর্থনৈতিক ব্যবস্হা পরীক্ষা করে দেখি, তাহলে দেখতে পাব যে এর দৃষ্টিভঙ্গি হল এটি মানুষের প্রয়োযন (need) এবং এসব প্রয়োজন পূ্রণের উপকরণ নিয়ে কাজ করে।পুজিবাদী অর্থনৈতিক ব্যবস্হা মানুষের কেবল মাত্র বস্ত্তগত দিকটি নিয়েই আলোচনা করে এবং এটি তিনটি মূল নিতীর উপর প্রতিষ্ঠিতঃ

১.প্রয়োজনের সাথে সংশ্লিষ্ট পণ্য ও সেবার আপেক্ষিক অভাব (relative scarcity) রয়েছে।এর অর্থ হল মানুষের ক্রমবর্ধমাণ প্রয়োযন পূ্রণের জন্য পণ্য ও সেবার অপর্যাপ্ততা ।তাদের দৃষ্টিতে এটাই হল সমাজের অর্থনৈতিক সমস্যা।

২অধিকাংশ অর্থনৈতিক গবেষণা ও অধ্যায়নের ভিত্তি হল উৎপাদিত পণ্যের মূল(value)

৩.উৎপাদন,ভোগ ও বন্টনে দামের (price) ভূমিকা।দাম হল পূজিবাদী অর্থনৈতিক ব্যবস্হা একটি মৌ্লিক বিষয়।

পণ্য ও সেবার আপেক্ষিক অভাবের ক্ষেত্রে বলা যায়, পণ্য ও সেবা মানুষের অভাব পূ্রণের উপকরণ হওয়ায় এ অবস্হার সৃষ্টি হয় ।তারা বলে মানুষের প্রয়োজন রয়েছে যা পূ্রণ করতে হয় এবং এ প্রয়োজন পূ্রণের উপকরণ থাকতে হবে। এ প্রয়োজনসমূহ পুরোপুরিই বস্ত্তগত (materialistic)। এ গুলো হয় দৃশ্যমাণ (tangible), যেমনঃ খাদ্য ও বস্ত্রের পয়োজন যা মানুষ অনুভব করে এবং অদৃশ্য্মান (intangible) অর্থাৎ সেবার প্রয়োজন ,যেমনঃ ডাক্তারের সেবা,শিক্ষকের সেবা ইত্যাদি।নৈ্তিক প্রয়োজন,যেমনঃগৌ্রব ও সম্মান অথবা আধ্যাতিক প্রয়োজন ,যেমনঃস্রস্টার উপাসনা করা,এগুলো
অর্থনৈতিকভাবে স্বীকৃতি নয়।একারনে এগুলো পরিত্যাগ করা হয়, ফলে অর্থনৈতিক  স্বীকৃতি নয়।একারনে এগুলো পরিত্যাগ করা হয়, ফলে অর্থনৈতিক আলোচনা এগুলোর কোন স্হান নেই।

প্রয়োজন পূ্রণের উপকরণ সমূহকে পণ্য ও সেবা বলা হয়। পণ্য হল দৃশ্যমান প্রয়োজন পূ্রণের উপকরণ এবং সেবা হল অদৃশ্যমাণ প্রয়োজন পূ্রণের উপকরণ। তাদের দৃষ্টিতে যা পণ্য ও সেবাকে প্রয়োজন পূ্রণ করতে দেয়, তা হল পণ্য ও সেবার মধ্যে থাকা সুযোগ ও সুবিধা বা উপযোগ।এই উপযোগ এমণ একটি বৈশিষ্ট যা প্রয়োজন পূরনের জন্য আকাংখিত বস্তু থেকে পাওয়া যায় । যেহেতু প্রয়োজন হল অর্থনৈ্তিক আকা্ঙ্খিত প্রতিটি বস্তুই অর্থনৈতিক ভাবে উপকারী-হোক তা অপরিহার্য বা তা নয়, কিংবা কিছু সংখ্যক লোক এটিকে উপকারী মনে করুক। এটি ততক্ষন পর্যন্ত অর্থনৈতিক ভাবে উপকারী যতক্ষণ পর্যন্ত কেউ একে আকাক্ষিত মনে করে। যেকনো বস্তুকে অর্থনৈ্তিক ভাবে লাভজনক কিনা শুধমাত্র সে দৃষ্টিতে বিবেচনা করা হয় , যদিও বা জনমত , এটিকে অলাভজনক ভাবে বা ক্ষতিকারক মনে করে। সে কারনে মদ ও হাসিস অর্থনৈতিকভীদ দের কাসে লাভ জনক, কেননা কিছুলোক এগোলো চাই।

অ্ন্য কোনো বাস্তবতা বিবেচনায় না এনে কেবল মাত্র প্রয়োজন পুরণ করে-এ দৃষ্টিভঙ্গি থেকে অর্থনৈতিক প্রয়োজন পুরনের উপকরনের দিকে দৃষ্টি নিবদ্ব করে অর্থাৎ পণ্য ও সেবার দিকে লক্ষ্য করে । সুতরাং সে প্রয়োজন ও উপযোগ এ দুটি যেরুপ বিদ্যমান ঠিক সে ভাবেই দেখে, কিন্তু এগুলো কিরকম হওয়া উচিত সে দিকে দৃষ্টিপাত করেনা অর্থাৎ সে অন্য কিছুকে বিবেচনাই না এনে উপযোগকে প্রযোজন পূরণের নিয়ামক হিসেবে দেখে।সুতরাং কিছু লোকের চাহিদা মিটানোর কারণে সে মদকে অর্থনৈতিকভাবে মূল্যবান হিসেবে বিবেচনা করে এবং অর্থনৈতিক মুল্য বিবেচোনা করে মদ প্রস্তুতকারী হিসেবে মনে করে মদ প্রস্তুতকারীকে একজন সেবাপ্রদান কারী হীশেবে মোনে করে ।কারন এটী কিছু ব্যক্তির অভাব পূ্রণ করে।

এটিই হল পুজিবাদে প্রয়োজন ও তা পূরণের উপোকরনের প্রকৃ্তি।সেকারনে  অর্থনৈতিক সমাজের প্রকৃ্তির তোয়াক্কা করে না , কন্তু তারা অর্থনৈতিক বস্তুগত সম্পদ বা অর্থনৈতিক পণ্যের ব্যাপারে যত্নশীল কারন এগুলো প্রয়োজন পুরণ করে।সুতরাং তাদের মতানুসারে অন্য কোন কছু বিবেচনায় না এনে মানুষের প্রয়োজন পুরোণ এর উপকরণ যোগানের জন্য পণ্য ও সেবা সরকার নিশ্চিত করা দরকার।অর্থাৎ প্রয়োজন পুরোনের উপকরন সরকার করা দরকার। প্রয়োজন পুরোনের উপকরণ হিসেবে পণ্য ও সেবা যেহেতু সীমিত সেহেতু এগুলো মানুষের সব প্রয়োজন পুরোণের জন্য পর্যাপ্ত নয়।কারন তাদের দৃষ্টিতে এই প্রয়োজন সমূহ অসীম এবং ক্রমাগত বৃদ্বি পাচ্ছে । এটি এ কারনে যে, মানুষের রয়েছে এমন একটি প্রয়োজন যা তাকে পুরোণ করতে হয় এবং কিছু প্রয়োজন রয়েছে যা নগরায়নের সাথে বৃদ্বি পায়।এই চাহিদা সমুহ গুনিতক হাড়ে বাড়তে থাকে এবং এগুলি পুরোপুরি পুরোণ করা দরকার।যদিও পণ্য ও সেবা বৃদ্বি পাক না কেন, এ গুলাও কখনও পুরোণ হবার নয়।এই ভীত্তি থেকে অর্থনৈতিক সমস্যার সুত্রপাত হয়, যা হল প্রয়োজনের ভুঝা এবং এগুলো পুরোণের জন্য উপকরণের অপ্রতুলতা অর্থাৎ মানুষের সব অভাব পুরোণের জন্য পণ্য ও সেবার অপ্রতুলতা।

এই দৃষ্টিভঙ্গি থেকে সামাজ একটি অর্থনৈতিক সমাস্যা্র সম্মুখীন হয় তা হল পণ্য ও সেবার আপেক্ষিক দুষ্প্রাপ্যতা । এ দুষ্প্রাপ্যতার অপরিহার্য হল কিছু প্রয়োজন আংশিক ভাবে পুরণ হয় এবং কিছু কখনোই পুরণ হয় না। যেহেতু এটাই হল অবস্থা সেহেতু এটি অপরিহার্য যে সামাজের সদস্যগণ এমন আইনের ব্যাপারে একমত হবেন- যা নির্ধারণ করবে কোন প্রয়োজন গুলো পুরোণ হওয়া উচিত এবং কোন গুলো নয়। অন্যকথায় এমন আইন প্রনয়ন করা জরুরি যা অসীম অভাব পুরোণের জন্য সীমিত সম্পদ বন্টনের ব্যা্বস্হা করবে।সুতরাং তাদের দৃষ্টিভঙ্গি মানুষের চেয়ে প্রয়োজন ও সম্পদকে বেশী গুরুত্ব প্রদান করেছে।অর্থাৎ সমস্যা হল প্রয়োজন পুরণের জন্য সম্পদ কে সুলভ করতে হবে,কিন্তু সেটা প্রত্যেক ব্যক্তির জন্য নয়।সুতরাং এটি অপরিহর্য যে যেসব আইন প্রণ্যন করা হবে সেগুলোকে অবশ্যই সর্বোচ্চ পরিমান উৎপাদনের নিশ্চয়তা প্রদান করতে হবে যাতে করে সম্পদের সর্বোচ্চ সরবরাহ অর্জন করা সম্ভবপর হয়। অর্থাৎ সামগ্রিকভাবে জাতির কাছে পণ্য ও সেবা সরবরাহ করা যায়, অবশ্যই প্রত্যেক ব্যক্তির কাছে নয়।সুতরাং পণ্য ও সেবার বন্টন উৎপাদনের সমস্যার সাহতে অঙ্গা অঙ্গিভাবে জড়িত এবং অর্থনীতির অধ্যা্যন ও গবেষণার উদ্দেশ্য হল সমাজের ভোগের জন্য পণ্য ওসেবা বৃদ্বি করা।সুতরাং এটি অবাক হওয়ার বিষয় নয় যে সব নিয়ামক জাতির আয়ের (GDP and GNP) আকারকে প্রভাবিত করে সেগুলোর অধ্যায়ন বাদ বাকি দুষ্প্রাপ্যতার সমস্যার সমাধান করার জন্য অন্তত গুরু্তপূর্ণ বিষয়। কারন তারা মনে করে উৎপাদন বৃদ্বি করা ছারা দারিদ্রতা ও বঞ্চনা নিসরন করা সম্ভব নয়।সুতরাং সমাজ যে সব  অর্থনৈতিক সমস্যার সম্মুখীন হছে সেগুলোর সমাধান কেবল মাত্র উৎপাদন বৃদ্বির মাধ্যমেই করা সম্ভব।

উৎপাদিত পণ্যের মুল্য বলতে এর গুরত্তের মাত্রাকে বুঝায় ;যেখানে কোন এক বিশেষ ব্যাক্তির বা কোন এক বিশেষ বস্তুর সাপেক্ষে সে মাত্রা নির্ধয়ারিত হয়।প্রথম ক্ষেত্রে এতাকে 'উপযোগের মুল্য' (The value of the Benefit) বলা হয় এবং দ্বিতীয় ক্ষেত্রে এটিকে ''বিনিময়ের মুল্য বলা হয়''(Value of exchange) বলা হয়। একটি বস্তু থেকে প্রাপ্ত উপযোগকে যেভাবে বর্ণনা করা যায় তার চুম্ভকাংশ হলঃ একটি বস্তুর যে কোন এককের উপযোগের মুল্য এর প্রান্তিক উপযোগ দ্বারা পরিমাপ করা হয় অর্থাৎ সর্বনিম্ন প্রয়োজন যে পরিমাণ বস্তু দ্বারা পুরণ করা যায় যে পরিমাণ বস্তুর উপযোগ । তারা এটিকে ''প্রান্তিক উপযোগ তত্ব'' বা''The theory of Marginal Utility'' বলে।এর অর্থ হল উপযোগ কেবল মাত্র এর উৎপাদনের দৃষ্টিভঙ্গি থেকে পরিমাপ করা হয় না অর্থাৎ উৎপাদন খরচ দ্বারা মুল্যায়িত হয় না, তাহলে সে ক্ষেত্রে চাহিদা বিবেচনা না করে কেবল যোগানই বিবেচনা করে হত। আবার এটিকে কেবল মাত্র ভোক্তার দৃষ্টিভঙ্গি থেকে বিবেচনা করা ঠিক হবে না ।অর্থাৎ এর উপযোগ এবং চাহিদা বিবেচনা করার সাথে সাথে এর আপেক্ষিক দুষ্প্রাপ্তা বিবেচনা করতে হবে।কেননা এতে করে যোগানের বিষয় হিসাবে না এনে চাহিদা বিবেচনা করা হবে।বাস্তবিকভাবে তারা বলে যে, যোগান ও চাহিদার ভিত্তিতে একত্রে উপযোগকে দেখা উচিত। সুতরাং সর্বনিম্ন যে উপযোগ প্রয়োজন পুরণ করে তার ভিত্তিতে একটি বস্তুর উপযোগ পরিমাপ করা হয় অর্থাৎ সন্তুষ্টির সর্বনিম্ন বিন্দু থেকে ।সুতরাং এক টুকরু রুটির মুল্য সব চেয়ে কম ক্ষুধার্থ থাকা অবস্থায় পরিমাপ করা হবে, সর্বাধিক ক্ষুধার্থ অবস্থায় নয় এবং সেসময় বাজারে রুটি সুলভ নয় এমন অবস্থায় পরিমাপ করা যাবে না।

Status of people of knowledge...

The people of knowledge have a special status in Islam,we should respect them

''Say:'' Are those who know equal who know not?''it is only men of understanding who will remember.''[TMQ az zumar9]

Jabir (ra) reported: After the better of Uhud, the Prophet(saw) arranged the the burial of two of the martyrs in one grave. in each he would ask,''which one of them had learnt more Quran by heart?''He placed whichever was thus pointed out to him, first in the lahd (type of grave).[Bukhari]

Ubaadah b. as-Saamit (ra) narrated that the messenger of Allah said: ''He is not from my Ummah who does not acknowledge the honour due to our elders, who shows no mercy to our younger ones and nor recognises the right of the scholar.''Al Munziri said: reported by Ahmad with a hasan chain. Al Haytami said: reported by Ahmad and At Tabaraani and its named is Hasan.

Abdullah b. Al Masud (ra) narrated that the messengers of Allah said:''let those be nearest to me in shala (prayers) who are mature possess (religious) knowledge, then those who are nearest to them in this respect. ''he repeated this three times and then added,''beware of indulging the loose takes of the markets (when in the mosque,''[Muslim]

Abu Musa (ra) narrated that the messenger of Allah said: ''it is out of the reverence to Allah that we respecting an aged Muslim, and the one who commits the Quran to memory and does not exaggerate pronouncing its letters and nor forgets it after memorising,and the respect the just ruler.''reported by Abu Dawud.An Nawawi said the hadeeth is the Hasan.Ibn Muflih ssaid the isnad is jayyid.

May Allah enable us to gain the correct knowledge and apply it.

The rewards of gaining knowledge...

Al-Bhukhari narrated through Mu'ayiyya bin Abu Sufian: the messenger of Allah said: ''The one for whom Allah wills good (khayr), He grants him Fiqah in the Deen.''

It was narrated that Umar bin Al-Khattab said: ''The death of one thousand worshippers who pray at night and worship in the day is less serious than the death of one intelligent knower (baseer) of the halal and haram of Allah.

All these narrations indicate to us as Muslims,and emphasise the importance of seeking knowledge.

Abu Huraira said: The messenger of Allah (peach be upon him) said: ''The word of wisdom is the lost property of the believer,so wherever he finds it he has a better right to it.''(Tirmidhi)

Abu Dardaa(ra) said: ''To leans of one issue (in deen) is better for me than to pray the entire night.''

He also said: ''The Scholar and the seeker of knowledge are the partners in the sharing of good. other men are hungry and there is no good in them.''

Fath Al Musilee (ra) said:''would the sick person who is not fed or given everything to drink or given any medicine, not die?''The people replied:''surely!''he said:''it is the same with the heart, it would die knowledge and wisdom is withheld from it.''

Narrated Abdullah bin Masud(Allah be pleased with him): The prophet (peace be upon him) said:''do not wish to be like anyone except in two cases.(1)[The first is] A person whom Allah has given wealth and he spends it righteously; (2)[The second person] The one whom Allah has given wisdom and he act according to it and teaches it to others.''(Shahi al Bukhari vol 1)

Abu Huraira said: the messenger of Allah (peace be upon him) said:''people are like mines of silver and gold;the more excellent of them in the days of ignorance are the more excellent of them in the Islam when they attain knowledge.''(Muslim,Miskat)

The recommended knowledge...

Gaining knowledge in the other areas of Islam which is beyond the knowledge of the fundamentals of Aeeda and direct Ahkam for our lives is mandub recommended . such as knowing the evidences for the Ahkam, konwledge of the Seerah, Islamic history (Tarikh), Tafseer,Arabic language, IIm al-hadeeth and usul Al-Fiqah.

We should strive to achieve this knowledge continuously.

What type of knowledge is fard ul ayn?...

Firstly, it is obligatory upon us all to believe in Islam definitively without a doubt and therefore this knowledge must known to us . This the knowledge of the fundamentals of Aqeeda

Allah says: ''And verily guess is no substitute for the truth.''[TMQ53:28]` 

And Allah say: ''They have no (certain) knowledge . they follow nothing but conjecture. For surely; they killed him not ('Isa)''[TMQ4:157]

''Do you have llm for that which you claim so that you provide us with? you follow nothing but conjecture (Zann).''[TMQ6:148]

''These are nothing but names which you have devised, you and your fathers, for which Allah has sent down no authority. they follow nothing but conjecture and what their Nafs desire. even though there has already come to them the Guidance from their Rabb.''[TMQ53:23]

Jalaluddin as-Suyuti, a Mujtahid Imam of the shafi madhab commented of this verse, that the people had zann (conjecture) which is opposed to knowledge(ilm) i.e. certain knowledge. he also stated that Allah had sent down definitelyproof (Burhan Qati) for the truth of the Islamic Aqeeda.[Tafseer al jalalayn page 627.it stated in reliance of the Traveller Ahmad ibn naqib al mirsi (ra)(769/1368) book of qada (judiciary)]
In all these and other ayaat (verses) to do with beliefs Allah censures those who take the beliefs through conjecture (zann) decisively prohibits them from this.

Therefore it is prohibited  for us to have emotional belief and belief based on imitation.we must know for our themselves that Allah exists, that Muhammad (saw) is his last messenger, The Quran is the word Allah and whatever is contained it is the truth such as belief in the angels, previous books, previous prophets, the day of judgement, jannah,jahannam etc.

Secondly, it is individual obligation us to know the Sahriah rules related to our own lives and actions.

Allah has addressed us directly in the Quran on so many occasions:

''O you believe, obey Allah and his messenger''.

We know that our purpose in life is to worship Allah as Allah said:

''I have not created jinn or mankind expect that they worship me.''[TMQ51:57]

Allah has also clear ordered us to talk from the messenger(saw):

''And whatsoever the Messenger [Muhammad(saw)] gives you, take it,and whatsoever he forbids you, abstain(from it).''[TMQ59:7]

Therefore we must at least know the shariah rules relating the fara'id (obligation ) Muharramat (prohibition) from our action such as:
-The Ahkam (rules) of Salah
-The Ahkam of relationships with the opposite sex
-The Ahkam of responsibility to parents
-The Ahkam of buying
-The Ahkam of replying to the salam
-The Ahkam of backbiting
-The Ahkam of working for khilafah
-The Ahkam of riba(usury)

whatever action we undertake we need know the hukm before performing the action, there is a principle in usul: Every action requires a hukm and every hukm requires an evidence

therefoe it is fard for a doctor to know the ahkam relating to his field, e.g. is post mortem allowed,
 rules relating treating rhe opposite sex, using intoxicants for medical purposes etc.

foe an imam of the mazid it is fard to know the ahkam relating to reading the prayer , the obligations of the khudba, the responsibility towards the Muslim, the obligations of speaking the truth from the Mimbar etc.

it is fard for the teacher to know whether it is permitted to teach subjects that contradict Islam and promote kufr, the ahkam of teaching members of the opposite sex, the ahkam of disciplining the student.

it is fard for the husband to know his obligations toward his wife,what are the prohibited action to undertake with her, how can he discipline her if she is disobedient, etc. similarly for the wife to know her responsibilities towards her husband, parent towards the child, child towards the parents and so on.

It is fard for the khalifah of the Muslims to know ahkam relating to his responsibility, etc.

We must ensure that we follow the shariah and not rules invented from the mind

In the hadith in sahih of bukhari, on the authority of 'Urah b. al zubayr who said: 'Abd Allah b. 'Amr b. al- 'As overcame us with proof. I heard him say: Allah will not deprive you of knowledge after he has given it to you, but it will be taken away through the death of the learned man (Ulema'a) with their knowledge. there will remain ignorant people who, when consulted , will give verdicts according to their opinions whereby they will mislead others and themselves go astray.''i.e. they give fatwas according to their own opinions which are not derived from the Islamic evidence.

Hadith narrated by al-daraqtuni in al-afrad, of Anas of the prophet (saw), where he said ''whomever cheats my Ummah has the curse of Allah, the angles and the combined, upon him. they asked: what is cheating, oh prophet of Allah? he said:if he invented an innovation for them, and they acted upon it.''

''whoever speaks about the Quran without any knowledge , then let him seek his place in the fire of hell.''
[Tirmidih, Abu-Dawud]

Islam has forbidden us from following any path other than the path of ''llm: ''And follow not that of which you have no knowledge. verily! the hearing, and the sight, and the heart, of each of those you will be questioned (by Allah).''[TMQ17:36]

Even if we are not aware of the evidence, we must know that the hukm is derived from the Islamic texts by legitimate ijtihad

''so ask the people of the reminder (ahl al-zikr)if you do not know.''[TMQ21:7]

He has ordered the one who does not have the knowledge to ask one who is more knowledgeable than him.

It has also been narrated on the authority of jabir(ra): a man was struck by a stone that fractured his skull. then he had a wet dream. he asked his companions-do you know of a permit(Rukhsa) for me to perform Tayammum (dry ablution)?-they said: we do not find any permit for you and you can use water .he then had a death and died. The Prophet(saw) said: ''verily, it would have sufficed for him to make Tayammum, so tie a piece of the cloth around his head and wipe over it and wash the rest of of his body.'And the prophet(saw) said: ''why did they not ask when they did not know. Indeed, the cure for inability and lack of knowledge is to ask.''[Abu-Daud:275,ibn majah:565,ahmad:2898] the messenger (saw) instructed them to ask about the Hukm Shar'ai.

We have to be careful from whom we take our knowledge in relation to the Shariah rules, they should be someone we trusts and someone who basis their opinions upon the Islamic evidence.

A narration of Imam Zuhri spring to mind, ''Be careful from whom you take your knowledge, because that is your Deen.''

We should beware of all government Mufti's, scholar and Imams-also whose who have openly violated the Shariah or given verdicts that contradict the Qati(definitive) matters.

Abu Hanifa said: ''If you see the scholar at the gates of the ruler then accuse him in his Deen.''

True scholars never compromise the truth. let us lake the example of Imam Ahmad Ibn Hambal (rahimallah), the master of hadeeth, the Mujtahid of Makkah and to whom the Hambali Madhab is attributed.in his time Ma'moon became khaleefah who adopted the Mu'tazilla belief that the Quran was created and attempted to force this belief upon the masses.

He started with the Ulema as they were the ones who had the leadership over the Ummah. Amongst the Ulema was Imam Ahmad who refused to accept this corrupt doctrine. His uncle went to him and asked him to say with his tongue what he does not accept in his heart, to this he responded, ''if the Alim stays silent in the face of falsehood when will the truth become manifest.''

The importance of seeking knowledge..

The Prophet(saw) said:''Seeking knowledge is an obligation upon every muslim''.

Today unfortunately we see many Muslims who when it comes to their eduction, work or even entertainment they would gain a lot of knowledge regarding these areas. however it comes to the Deen they have vary little. Indeed the Prophet(saw) mentioned this time:

Hazzam bin Hakim narrated from his uncle from the messenger of Allah who said: ''you in a time of many jurisprudents (fuqaha), few speakers,many who give and few who ask; so action in this time is better than knowledge. there will soon come a time of few jurisprudents, msny speakers, many who beg and few who give; so knowledge in this time is better than action''.

Why are you Muslim?......

it may sound like an obvious question but often many of us don't have a clear answer to it. i remember being asked this question by my elder brother when i was fourteen year ago. my initial answer was ''well our family was Muslim''. his reply to this made me think. he said if your family were Hindu or christian, would you be as a well? I replied with a strong,' no Islam is the truth'. the discussion that followed made me questions thebasis of my life and changed my life for ever. he triggered me to think about how to prove that Islam is truth rather than believing it emotionally or blindly. in fact Allah has commanded people for imitating their forefathers and adopting their belief without clear evidence...

Allah says in the holy Quran:

''And verily guess is no substitute for the truth''[TMQ53:28]

''They have no knowledge, they follow nothing but conjecture. for surly, they killed him to [ Isa]''
[TMQ4:157]

''These are nothing but names which you have devised, you and your father. for which Allah has send down noauthority. they follow nothing but conjecture and what their Nafs desire. Even though there has already come to them the guidance from their Rabb''[TMQ53:23]

Do you have knowledge for that which you claim to provide us with? you follow nothing but conjecture (zann)[TMQ6:148]

The followers of other religion have no decisive proof for their belief. therefore they believe in their religions semotionally or through imitation. some them think that you just have to have faith without clear proof. ever when it come to normal things in life people apply a lot of thought such as baying a car , house, choosing an University course or which bank to join, so how can it be that when it come to the most important questions about life. which define the purpose of our lives that we should just have ''faith''without being convinced absolutely.

it is therefore vital for a Muslim to believe in the existence of Allah without any doubt what soever to believe in the prophethood of Muhammad (s.a) and that the Quran is final revelation sent by Allah. to Humanity Islam is unlike as it has a decisive proof that convinces the mind.

Proof of the Quran .....

Once we have conclude definitively that Allah exists the next obvious question that arises is that has Allah sent a revelation us to follow. it is the clear that we are not able to communication with god and therefore we are unable to know what he wants us to do. how he wants us to worship him and how we should solve the problems we face in life. all of this question would remain unresolved unless their the creator has communica- tion with us and given us a guidance to follow.



As Muslim we are believe that throughout history. There have been messengers and prophets. men send from the creator. bringing laws and revelation on how man should conduct his life. they were given miracles with proved to mankind that they have a communication with god and a revelation from him. A miracle is something which he goes against the laws of nature which is impossible for anything else to do; by miracles the prophets were able to prove their direct relationship with God. For example prophet Musa (as) had a stick which parted the red sea. Prophet Isa (as) had the ability to cure the sick by just touching them.

But how do we know of these messenger existed? The miracles performed by above prophet were only miracles for that specific period of time. But how we do know that they were not just legends and fables? So what miracles do we have right now to convince us and guide us through our life.

The Quran itself is the main miracles that prophet (saw) brought which is different to the physicals miracles of the other prophets as they limited to their times only.The Quran is an intellectual miracles that the proves of Islam. is was revealed to Muhhamad (saw) in the 6th century. its exists today and has been revealed for all times.

It is an established fact that the Quran was proclaimed by Muhammed(saw) in Arabia over fourteen hundred years ago. in order for us to prove decisively that it is from Allah. We must first consider the possible sources of the Quran and then eliminate this to arrive at its true origin.

The only possible sources of the Quran are...

* The Arabs
* Muhammad (saw) himself
* Allah (swt)

At the time it was revealed the pagan of Arabs were deeply into poetry. It was an indication of nobility in society. people used to go to the deserts for days just write poetry. the Arabic language has great fluidity and depth of expression. so it was held high in esteem by the Arab. Allah in the Quran challenged the Arabs to produce something comparable to it in language and they failed to do so.

They may say: he forged it (the Quran).say...bring you them ten forged sura (chapters) like unto it and call whom soever you can, other than Allah (to your help). if you speak the truth. [TMQ11:13]

They failed to do so, Allah then reduced the challenged to something that at first glance may sound easy .Allah said....

''If you are in doubt of what we have revealed to our messenger, then produce one chapter like it . call open all your helper. Besides Allah, if you are truthful''. [TMQ2:23]

The smallest chapter in the Quran, sura al -Kauther is only three sentence long surely someone history must have matched this challenged? the Arabs at time of muhammad (saw) failed to do so. although they were the best Arabic  language .

 For none Arabs something this maybe difficult to perceive as they do not appriciate the language of the Quran directly, however everyone can agree that any piece of literature written by humans being can be matched ; people can copy its style and produce something comparable to it in quality. if we look at great English authors like Shakespear no one would claim that they were prophet and that their works are miraculous in nature. Even though they may have been geniuses in language, people can easily write something similar in excellence to three sentence from their books. Despite having the Arabic language its letter, grammars, syntax and dictionaries available today. the Arabic linguists can not construct any  piece of language that is comparable to the Quran.therefore, it is impossible that the Quran was by written by any of the Arabs.

 It is also inconceivable that the quran is the speech of muhammad (saw). after all he is one of the Arabs. also whatever level of genius people may assing to him, he was a still a human being and one of his tribe and nation. since the Arabs failed to bring like of the quran. this equally applies to  muhammad (saw). moreover muhammad(saw) has left saheeh ahaadeeth (sound narration) and matuwaatir ahaadeeth(definitive narrations) whose authenticity is beyond doubt. if any of these ahaadeeth were to be compared with any verse of Quran, their would be similarity between them of style. he (saw) used to utter the revealed verse and say the hadeeth at the same time and yet there is a difference between them in style. when ever any man attempts to diversify his speech, it will remain similar in style, because it is a part of him.since their is no similarity between hadeeth and the verse in style. the Quran is absolute not mohammad (saw) is speech. it is important to point out that none of the Arabs. who despised Muhammad (saw), particularly at the time, were the most acquainted with the style of arabic speech yet never claimed that the Quran was Muhammad (saw) speech or even similar to his speech..

To this day muslim and non muslim scholar have not been able to find any contradiction or mistake in the Quran, moreover, if one was to compare word by word a copy Quran published today to one of the first copies of the Quran available then one would find that not a single word has been omitted or added. copies of the Quran dating back to the first century of the islam can be found in Istanbul and tashkent . Allah (swt) says in the Quran......

''Do they not ponder about the Quran? if it had come from other than God  they would surely have found there in much contradiction''..

There are many texts available today claiming divine status from God, like the Bible of the christian and the torah of the jews etc. however, they have no proof that they have been revealed by God, if they are not miraculous  in nature then their is no reason to believe in them.

Allah says: '' say ye; '' we believe in Allah, and revelation given to us, and to Abraham, Ismail, Issac, Jacob, and the tribes, and that given to Moses and Jesus, and that given to all prophets from their lord. we make no difference between one and other of them and then we bow to Allah ( in Islam).'' [TMQ: al Bakarah:136]

Once we have establish through rational, proof that Allah exists and that the Quran is  the world of Allah. we must believe in everything that the Quran inform us of and commands us with, whether we can perceive them or not. therefore, we must have Iman(belief) in the day of Resurrection, in paradise (jannah) and hell, in reckoning and punishment, in angle, in jinn, in shayaateen and other that the Quran or hadeeth  mutawaatir (definitive narrations) have mentioned. To believe in these things is therefore not irrational just because we cannot see them or sense them physically as we have conclusively proved the Quran being from Allah which informs us about all of these.

Once the Iman in Allah, his messenger and the Quran has been proven. every Muslim is obliged to believe in the Islamic Shari;ah as a whole. we cannot pick and choose as we like. As the shariah was revealed in the glorious Quran, and the messenger conveyed it. if someone disbelieves in this he would be a kafir. therefore, it is belief to deny the shariah rules as a whole, or any definite detailed rule amongst them. this is the case whether these ahkam(rules) are connected with worships(ibadaat) transactions(mu'amalaat), punishments (uqoobat), food etc.....

Proof of the existence of Allah.....

Let us being by discussing proof of the existence of Allah. Although we are taught theories regarding the origin of the universe and origin of the man such the big bang theory in the theory of evolution. we should realise that the they contradict the clear reality which everyone can sens .

There fundamental that proof that God exist is that anything that we sense around us whether it is the mountains , the trees, the sun, the moon, the star ,the animals and the human beings,are limited things and are not internal. By limited we mean that they have restrictions, a starting point and a ending point.they have definable attributes i.e. they are all finite. human being are born and die,there is no one alive who will not die . daring their life span .they will grow to a certain height. weight and volume .

It is the truth there are difference between the thins that exist in  the universe however all of them share of the quality of being limited and finite. the earth maybe huge but it steel has a certain shape, weight, volume by which it is limited. this applies to all planets, star, solar systems and galaxies may look huge to us as earth look huge to us and it is eternal. even all of the galaxies elements of the universe are added together they do not become unlimited there fore require and origins. no scientist could ever prove using hard fact  that the has no bounds.in fact when they said that the universe arose from the big bang and expending they inherently admit it is finite in size otherwise is could not expend!there is nothing reality which unlimited. no metter how hard we try we unable to fine anything unlimited around us.  all we can perceive is finite and limited.

Imam abu hanifa said:''i feel sorry about your states you cannot imagine one ship running without someone looking after its affairs, yet you think that for this whole world which runs exactly and percisely  there is no one who look after it and no one owns it.''

The attributes of the everything around us is that they are all needy and dependent in order to continue existing. they are not self-sustaining or independent. Man has needs has to satisfy in order to survive. he had organic need for example he must eat and drink if he is to survive. if he dose not he will die. we see the need and the dependency in plants and animals. they depand on other part of food chain for their existence. the water cycle is dependent in the sun, which is dependent on laws of the galaxies and of burning mass, and so on.. nothing we can see perceive in self-subsistent, so thing exists but do not have the power of existence. they can not control when they die and other bodies die. thus what we see is that everything around us is limited and finite.everything that is limited and finite is dependent and that is everything dependent upon something greater than it self. applying this to everything we see will bring us to a conclusion. is everything in the universe is dependent because it has not the power of bring in existence on its won accords. it also finite and limited. then what is everything dependent upon for its existence? its must be unlimited and independent creator.

today the various theories that the exists about the origin of the universe such as the ''big bang theory'' big bang big crunch theory. dialectic materialism . they contradict the simple fact of the need for an unlimited creator.

one example that highlight this is that origin of life. living things like plants. animals and human being are different from dead thing as they have certain features such as independent growth . motion and reproduction . if people believe that the universe has exist forever or that it evolved from single blast etc . this means that they that life also cvolved from inanimate or dead matter such as gases, liquids and solids.if this is the case then should be able to show us one example at least non-living things producing life.no such example of exists. in fact some of them say that this happened by coincidence million of years ago when certain amino acids and chemicals mixed together to produce the first life. if this is the case, then they should able to reproduce this ''coincidence'' with their billion of dollars worth of technology. but they are unable to produce must basic form. an ameoba, which is a single called organism. what scientists can do is manipulate the attributes that is exists with in living cells such as in genetic cloning. however this dose not mean that they are creating life from dead matter. they are simple manipulating the attributes the Allah he placed within life . just as we manipulate metal to produces knives and cars.

Allah says in the Quran ....


''Oh you who believe! believe in  Allah and his messenger and the book which he send to his messenger and the book which he send to those before (him). Any who denies Allah. his angel,his messenger and day of the judgement, has gone far, has gone astray[sura an - nisa].....

''So establish regular pryer''.[sura al-bakarah]

''As to the thief , male or female cut of his or her hands.[sura al- maida]

''Forbidden to you are dead ,meat, blood.the flesh of swine and that on which has been invoked the name of any other than Allah.[sura al-maida]

But no but your lord, they have no real faith, until they make judge in all disputes between them and find in their soul no resistance against your decision but accept them with the fullest submission .[sura an-nisa]......
